AN ACT
Amending title 38, chapter 3, article 4, Arizona Revised Statutes, by adding section 38-452; relating to displays on public property.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 38, chapter 3, article 4, Arizona Revised Statutes, is amended by adding section 38-452, to read:
38-452. Flags; prohibition; public property; applicability; definitions
A. Except as provided in subsection B of this section, a flag may not be displayed on public property in this state.
B. This section does not apply to any of the following:
1. The American flag or an official or replica of a flag of the uniformed services of the United States if the American flag or a uniformed services flag is displayed in a manner consistent with the federal flag code (P.L. 94-344; 90 stat. 810; 4 United States Code sections 4 through 10).
2. The POW/MIA flag.
3. The honor and remember flag.
4. The Arizona state flag.
5. An Arizona Indian nations flag.
6. A first responder flag. A first responder flag may incorporate the design of one or two other first responder flags to form a combined flag.
7. A blue star service flag or a gold star service flag.
8. Any historic version of the American flag.
9. any official flag of a public body or a public educational institution.
C. This section applies only to any person who is elected, appointed or employed by A public body or a public educational institution while engaged in an official capacity.
d. this section does not prohibit any approved educational curricula or deny the civil and political liberties of any person as guaranteed by the united states constitution AND the constitution of arizona.
e. For the purposes of this section:
1. "Public body" has the same meaning prescribed in section 39-121.01.
2. "Public educational
institution" has the same meaning PRESCRIBED in section 15-115.01.
d. this
section does not prohibit any approved educational curricula or deny the civil
and political liberties of any person as guaranteed by the united states
constitution AND the constitution of arizona.e[this state or any county, city, town,
municipal corporation, school district, public educational institution or any
board, commission or agency of any county, city, town, municipal corporation,
school district or public educational institution.][A public body or a public educational institution
while engaged in an official capacity.]
[D. For the purposes of this section:
1. "Public
body" has the same meaning as prescribed in section 39-121.01.
2. "Public
educational institution" has the same meaning as PRESCRIBED in section
15-115.01.]
