AN ACT
amending title 45, chapter 2, article 9, Arizona Revised Statutes, by adding section 45-571.03; relating to groundwater.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 45, chapter 2, article 9, Arizona Revised Statutes, is amended by adding section 45-571.03, to read:
45-571.03. Industrial water use; conservation; efficiency; definition
A. for each qualifying active management area, on or before January 1, 2026, the director shall include in a management plan adopted PURSUANT to section 45-568 or 45-569 conservation REQUIREMENTS for INDUSTRIAL uses that are within and outside of the service area of a DESIGNATED service provider and that Meet both of the following criteria:
1. Beginning on the EFFECTIVE date of this section, are not subject to any conservation requirements for industrial uses greater than a requirement to SUBMIT a plan to improve the EFFICIENCY of water use by the facility pURSUANT to an active management area management plan.
2. Use greater than one HUNDRED acre-feet of water per year.
B. NOTWITHSTANDING any other law, a management plan, the department, any POLITICAL SUBDIVISION of this state or any modifications to a management plan may not require a person who uses water for an industrial use to do any of the following:
1. obtain a certificate of assured water supply.
2. develop within the service area of a municipal provider designated as having an assured water supply.
3. enroll as member land in a multi-county water conservation district or otherwise meet a REPLENISHMENT obligation pursuant to title 48, chapter 22, article 4.
C. CONSERVATION REQUIREMENTS that are adopted PURSUANT to this section shall include on-site water reuse, RECYCLING and efficiency REQUIREMENTS.
D. For the purposes of this section, "Qualifying Active Management area" means an active management area where the legislature has specifically authorized the establishment of an alternative path to designation of assured water supply and an agricultural to municipal use program.
