AN ACT
amending section 44-7201, Arizona Revised Statutes; Amending title 44, chapter 29, article 1, arizona revised statutes, by adding section 44-7204; relating to ticket sales.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 44-7201, Arizona Revised Statutes, is amended to read:
44-7201. Definitions
In this chapter, unless the context otherwise requires:
1. "Bot":
(a) Means any automated software program that performs automatic and repetitive tasks and that is designed to impersonate or replicate human activity online.
(b) Does not include autofill or password management features built into an internet browser or provided through separate software.
2. "Event" means a concert, theatrical performance, sporting event, exhibition, show or similar scheduled activity that meets all of the following:
(a) Is open to the public.
(b) Is held in a public or private venue.
(c) Requires payment of an admission fee to attend the event.
3. "Operator":
(a) means a person or entity that owns, operates or controls a place of ENTERTAINMENT or that promotes or produces entertainment and that sells a ticket to an event for original sale.
(b) Includes an employee of an operator.
4. "original sale" means the first sale of a ticket by an operator.
3. 5. "Ticket" means a physical or electronic certificate, voucher, document, token or other evidence of a right for admission to enter a place of entertainment for one or more events at one or more specified dates and times.
Sec. 2. Title 44, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 44-7204, to read:
44-7204. Electronic ticket sales and resales; electronic ticket delivery requirements; exceptions
A. An operator shall deliver an electronic ticket to the purchaser at least fifteen days before the event.
B. If a purchaser purchased an electronic ticket less than fifteen days before an event, the operator shall deliver the electronic ticket to the purchaser as soon as reasonably possible after the purchase.
C. A ticket reseller shall clearly and conspicuously disclose an approximate delivery date for a ticket that is resold to a purchaser and that is to be delivered electronically.
D. This section does not apply to a ticket that is initially offered:
1. At no charge and access to that ticket is not contingent on providing a form of monetary consideration.
2. For a charitable purpose for which all proceeds from the ticket sale are provided to a charitable organization that qualifies as a nonprofit charitable organization under section 501(c)(3) of the United States Internal Revenue Code.
