A CONCURRENT RESOLUTION
proposing an amendment to the Constitution of Arizona; amending article IX, Constitution of Arizona, by adding section 26; relating to taxation.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:
1. Article IX, Constitution of Arizona, is proposed to be amended by adding section 26 as follows if approved by the voters and on proclamation of the Governor:
26. Vehicle miles traveled; taxing, monitoring and limiting prohibited; exception
Section 26. a. This state and any county, city, town, municipal corporation or other political subdivision of this state may not do either of the following:
1. impose a tax or fee on any person based on the vehicle miles traveled by the person in a motor vehicle.
2. enact any rule or law to monitor or limit the vehicle miles traveled by a person in a motor vehicle unless the rule or law REQUIRES that the person voluntarily consents to the monitoring or limitation.
b. this section does not apply to either of the folfollowing:
1. an interstate agreement that is established to administer the payment or reporting of fuel taxes or REGISTRATION fees for commercial vehicles that OPERATE in more than one state.
2. A motor vehicle owned and operated by any entity listed in subsection a of this section.
2. The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
