An Act
amending title 9, chapter 4, article 8, Arizona Revised Statutes, by adding section 9-500.52; repealing section 9-500.52, Arizona Revised Statutes, as added by this act; amending title 11, chapter 2, article 4, Arizona Revised Statutes, by adding section 11-269.30; repealing section 11-269.30, Arizona Revised Statutes, as added by this act; amending title 41, chapter 4, article 1, Arizona Revised Statutes, by adding section 41-710.03; repealing section 41-710.03, Arizona Revised Statutes, as added by this act; relating to immigration compliance.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 9, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 9-500.52, to read:
9-500.52. Compliance with federal laws; immigration; deportation; cooperation with federal agencies; contract requirement; investigations; private rights of action
1. The United States Department of Homeland Security.
2. The United states Customs and Border Protection.
3. The United States Immigration and Customs Enforcement.
B. A CONTRACT BETWEEN An independent CONTRACTOR AND A CITY OR TOWN IN THIS STATE SHALL CONTAIN A PROVISION THAT IF THE independent CONTRACTOR VIOLATES THIS SECTION, THE independent CONTRACT IS VOID.
C. AT THE REQUEST OF ONE OR MORE MEMBERS OF THE LEGISLATURE, THE ATTORNEY GENERAL SHALL INVESTIGATE A CITY OR TOWN, PURSUANT TO SECTION 41-194.01, THAT the member or members allege VIOLATES THIS SECTION.
D. A person may bring a private right of action to enforce this section.
Sec. 2. Delayed Repeal
Section 9-500.52, Arizona Revised Statutes, as added by this act, is repealed from and after December 31, 2028.
Sec. 3. Title 11, chapter 2, article 4, Arizona Revised Statutes, is amended by adding section 11-269.30, to read:
11-269.30. Compliance with federal laws; immigration; deportation; cooperation with federal agencies; contract requirement; investigations; private rights of action
1. The United States Department of Homeland Security.
2. The United states Customs and Border Protection.
3. The United States Immigration and Customs Enforcement.
B. A CONTRACT BETWEEN An independent CONTRACTOR AND A COUNTY IN THIS STATE SHALL CONTAIN A PROVISION THAT IF THE independent CONTRACTOR VIOLATES THIS SECTION, THE independent CONTRACT IS VOID.
C. AT THE REQUEST OF ONE OR MORE MEMBERS OF THE LEGISLATURE, THE ATTORNEY GENERAL SHALL INVESTIGATE A COUNTY, PURSUANT TO SECTION 41-194.01, THAT the member or members allege VIOLATES THIS SECTION.
D. A person may bring a private right of action to ENFORCE this section.
Sec. 4. Delayed Repeal
Section 11-269.30, Arizona Revised Statutes, as added by this act, is repealed from and after December 31, 2028.
Sec. 5. Title 41, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 41-710.03, to read:
41-710.03. Compliance with federal laws; immigration; deportation; cooperation with federal agencies; contract requirement; funding; private rights of action; definition
A. Notwithstanding any other law, This state, a state agency or an independent contractor of this state or a state agency shall comply with all federal laws, rules, regulations or orders that relate to immigration and deportation, and shall cooperate with any of the following federal agencies:
1. The United States Department of Homeland Security.
2. The United states Customs and Border Protection.
3. The United States Immigration and Customs Enforcement.
B. A CONTRACT BETWEEN An independent CONTRACTOR AND THIS STATE OR A state agency SHALL CONTAIN A PROVISION THAT IF THE independent CONTRACTOR VIOLATES THIS SECTION, THE CONTRACT IS VOID.
C. IF a STATE AGENCY VIOLATES THIS SECTION, the state agency shall deposit ten percent of the state agency's funding for the fiscal year into the general fund within thirty days after the violation.
D. A person may bring a private right of action to enforce this section.
E. For the purposes of this section, "state agency" has the same meaning prescribed in section 18-422.
