An Act

amending title 45, chapter 2, article 9, Arizona Revised Statutes, by adding section 45-581; relating to groundwater management.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 45, chapter 2, article 9, Arizona Revised Statutes, is amended by adding section 45-581, to read:

START_STATUTE45-581. Groundwater model; alternative model; notification of receipt; response; findings

A. Within five days after receiving an alternative groundwater model, the director shall notify in writing the person who submitted the alternative groundwater model of receipt.

B. Notwithstanding any other law, within sixty days of receipt of an alternative groundwater model, the director shall provide a written response to the applicant detailing:

1. Whether the department accepts the overall findings of the alternative groundwater model.

2. Whether the director accepts or denies each of the specific findings of the alternative groundwater model.

3. the rationale for the Director's rejection of any of the findings of the alternative groundwater model.

Sec. 2. Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
