AN ACT

 

amending title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-120.05; relating to school employees.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-120.05, to read:

START_STATUTE15-120.05. School employees; classroom instruction requirement; certification exemption; definitions

A. Each school in this state shall require each full-time administrative employee of the school to provide classroom instruction as a substitute teacher at least once per school year. 

B. Notwithstanding any other law, a school employee who provides instruction as a substitute teacher pursuant to subsection A of this section is not required to obtain a substitute teaching certificate from the state board of education.

C. Notwithstanding subsection A of this section, a school may not require an employee to annually provide instruction as a substitute teacher if the individual either:

1. Has not either obtained a fingerprint clearance card or been fingerprinted pursuant to section 15-512.

2. Is subject to discipline for immoral or unprofessional conduct.

D. For the purposes of this SECTION:

1. "administrative employee":

(a) includes a school principal, superintendent, business manager, business official or employee who provides administrative services to the school.

(b) does not include:

(i) An individual who regularly provides classroom instruction as a classroom, laboratory or other teacher.

(ii) An individual who regularly provides services directly to students, including transportation, instructional support or student support services.

2. "school" means a school district, a charter school or an individual school that is operated by a school district. END_STATUTE
