An Act
amending title 11, chapter 7, article 8, Arizona Revised Statutes, by adding section 11-1052; relating to the enforcement of immigration Laws.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 11, chapter 7, article 8, Arizona Revised Statutes, is amended by adding section 11-1052, to read:
11-1052. County detention facilities; arrestee identifying information; federal immigration and customs authorities; applicability; definition
A. ON a daily basis or on request of the united states immigration and customs enforcement, A county detention facility shall transmit the name, address, date of birth, gender and social SECURITY number of a person arrested for any of the following offenses:
1. BURGLARY pursuant to title 13, chapter 15.
2. Theft pursuant to section 13-1802.
3. Larceny.
3. SHOPLIFTING pursuant to section 13-1805.
4. ASSAULT On A LAW ENFORCEMENT OFFICER pursuant to section 13-1204.
5. Any other offense THAT RESULTS IN DEATH OR SERIOUS BODILY INJURY TO ANOTHER PERSON.
B. on request OF THE UNITED STATES immigration and customs ENFORCEMENT, A COUNTY DETENTION FACILITY shall provide THE UNITED STATES immigration and customs ENFORCEMENT with a photograph and any other physical descriptors of a person arrested for any of the offenses described in subsection a of this section. on request of the united states immigration and customs enforcement, a county detention facility shall provide the United States immigration and customs enforcement access to the person for an interview.
C. A county detention facility shall comply with and honor any requests made by the united states immigration and customs ENFORCEMENT.
D. This section does not apply to a county detention facility where a united states immigration and customs enforcement agent is stationed or if the county detention facility has an employee who is approved by the united states immigration and customs enforcement to conduct immigration and customs screening of persons who have been detained.
E. For the purposes of this section, "county detention facility" means any place used by a county sheriff's office for the confinement or control of a person for the offenses prescribed in subsection a of this section.
