Overview
Prohibits a broker from mandating a licensee's involvement in a labor union or external organization as a condition of employment.
History
Arizona's Constitution provides for the right to work, specifying no person may be denied employment due to non-membership in labor organizations. A person who violates this part of the Arizona Constitution or applicable right to work statutes is liable to the person injured and may be sued (A.R.S. § 23-1306, Arizona Constitution, Art. XXV).
Real estate employment agreements set forth all terms, including compensation, have a definite timeline and are signed by all parties. These agreements are most often made between an employing broker and a licensee (A.R.S. § 32-2151.02).
Provisions
1. Prohibits a broker from requiring any licensee, as a condition of employment, any agreement, membership or obligation involving a labor union or external organization. (Sec. 1)
2. Specifies The Multiple Listing Service, a real estate trade association and a realtor organization are included in the category of labor union or external organization. (Sec. 1)
