Overview
Defines terms related to the issue of general permits for the category of on-site wastewater treatment facilities. Outlines the requirements to obtain and operate under a general permit issued by the director of the Arizona Department of Environmental Quality (ADEQ).
History
A wastewater treatment facility is required to be operated pursuant to either an individual permit or a general permit issued by ADEQ. An on-site wastewater treatment facility (facility) is defined as a conventional septic tank system or alternative system installed at a site to treat and dispose of wastewater of predominantly human origin that is generated at that site (A.R.S. §49-201).
The director can issue a general permit for a defined class of facilities if:
a) the cost to issue individual permits cannot be justified by any environmental or public health benefit;
b) the facilities, activities or practice in the same class are substantially similar; and
c) the director is satisfied with the conditions under a general permit. (A.R.S. § 49-245).
Provisions
1. States a person who owns or operates a facility seeking coverage under a general permit to notify the Director of the person's intent to operate and apply for coverage under the general permit. (Sec. 1)
2. States a wastewater facility that complies with general permit rules is installed by an installer that is certified by the technology manufacturer and is operated by a service provider who is certified by the technology manufacturer. (Sec. 1)
3. Specifies that any design modifications or fees associated with the transaction of issuing general permits are not required by the Director. (Sec. 2)
4. Instructs the Director to issue a general permit that meets the following requirements;
5. The system complies with subsection A of this section;
6. The system is designed as a septic tank effluent pump system or a septic tank effluent gravity system and;
7. The system, including all components, septic tanks, collection system, secondary treatment disposal system and appurtenance, is owned or operated by a single person. (Sec. 2)
8. Requires a general permit be issued n later than January 1, 2026 (Sec. 2)
9. Defines "liquid effluence collection system" as a collection of lines that convey liquid effluent from multiple septic tanks, as primary treated wastewater, to a common secondary treatment system or common dispersal area through a small diameter pumping system or gravity system. (Sec. 3)
10. Defines "septic tank effluent gravity system" to mean a collection system that uses septic tank to separate solids and allow gravity flow of effluent a subsequent component. (Sec. 3)
11. Defines "septic tank effluent pump system" to mean a collection system that uses a septic tank to separate solids and incorporates a pump vault, pump and associated devices to convey effluent under pressure to a subsequent component. (Sec. 3)
12. Includes a legislative intent clause. (Sec. 3)
