HB 2330: disability; voluntary disclosure; licenses

Overview
Instructs the Arizona Department of Transportation (ADOT) to allow a person to indicate that they have a disability that can impair communication on a vehicle registration, driver license or nonoperating identification license application and maintain a database to share this information with state and local law enforcement.
History
ADOT is required to provide for an integrated and balanced state transportation system (A.R.S. § 28-331). ADOT must: 1) register motor vehicles and aircraft, license drivers, collect revenue, enforce motor vehicle and aviation statutes and perform related functions; 2) plan and carry out transportation improvements; 3) design and construct transportation facilities; 4) maintain and operate state highways, state-owned airports and state public transportation systems; 5) investigate new transportation systems; and 6) implement transportation safety programs (A.R.S. § 28-332).
A person must apply to ADOT within 15 days of purchasing or transferring a vehicle, trailer or semitrailer. An application must contain: 1) transferee's full name and the driver license number of the transferee or a number assigned by ADOT; 2) transfer's complete residence address; 3) a brief description of the car; 4) name of the manufacture; 5) vehicle's serial number; 6) last license plate number; 7) the date of sale by a dealer or manufacture, for a new vehicle; and 8) outlined criteria if the application has a lessor (A.R.S. § 28-2051).
ADOT must issue a nonoperating identification license that contains a distinguish number assigned to the licensee, the full legal name, the date of birth, the residence address and a brief description of the licensee and either a copy of the signature of the lessee or licensee's usual signature (A.R.S. § 28-3165). When issuing a driver license, it must contain: 1) a distinguishing number assigned to the licensee; 2) license class; 3) any endorsements; 4) the licensee's full name; 5) date of birth and residence address; 6) a brief description of the licensee, if there is no address; and 7) a copy of the signature or space to write the licensee's signature (A.R.S. § 28-3166).
Provisions
1. Requires ADOT, if a person voluntarily indicates on an application when registering a vehicle that the person has a disability that can impair communication, to:
a) not indicate on the person's title or registration that the person has a disability that can impair communication;
b) maintain in ADOT's statewide motor vehicle records system the indication that the person has a disability that can impair communication; and
c) establish procedures to share with state and local law enforcement that a person has a disability that can impair communication. (Sec. 2)
2. Directs ADOT, for an application or renewal of a nonoperating identification license, to:
a) not indicate on the applicant's or person's nonoperating identification license that the applicant has a disability that can impair communication;
b) maintain in ADOT's statewide motor vehicle records system the indication that the person has a disability that can impair communication; and
c) establish procedures to share with state and local law enforcement officers that a person has a disability that can impair communication. (Sec. 3)
3. Requires ADOT, for an application or renewal of a driver license, to:
a) not indicate on the applicant's driver license that the applicant has a disability that can impair communication;
b) maintain in ADOT's statewide motor vehicle records system the indication that the person has a disability that can impair communication; and
c) establish procedures to share with state and local law enforcement officers that a person has a disability that can impair communication. (Sec. 4)
4. Mandates that an application or renewal for a driver license or nonoperating identification license must include a space on which an applicant can voluntarily indicate that the applicant has a disability that can impair communication. (Sec. 3-4)
5. Adds in the application for a certificate of title to a motor vehicle, to include a space for an applicant to voluntarily indicate that the applicant or person has a disability that can impair communication. (Sec. 1)
6. Defines disability that can impair communication as a condition that can impair a person's ability to receive, send, process or comprehend concepts of verbal or nonverbal communication or graphic symbols. (Sec. 1-4)
