Overview

Consolidates the threshold amount for cocaine base and hydrolyzed cocaine with the nine-gram threshold for regular cocaine.

History

In Chapter 34 of the Criminal Code, the term threshold amount refers to a legally defined quantity of a drug that triggers enhanced criminal penalties for drug-related offenses. When the amount of drugs involved in an offense equals or exceeds the threshold amount, stricter sentencing guidelines may apply, as well as limitations on probation, suspension of sentence or early release from confinement.

Provisions

1.   Strikes the 750-milligram threshold amount for cocaine base and hydrolyzed cocaine. (Sec. 1)

2.   Adds hydrolyzed cocaine to the nine-gram threshold for regular cocaine. (Sec. 1)
