Overview
Describes the regulations and restrictions a municipality is prohibited from requiring an association to impose on a preliminary plat, final plat or specific plan.
History
Statute dictates that the planning agency of a municipality may not require a subdivider or developer to establish an association. A municipality is authorized to require the establishment of an association only to maintain private, common or community-owned improvements that are approved and installed as a part of a preliminary plat, final plat or specific plan (A.R.S. § 9-461.15).
Provisions
1. Specifies that if a municipality requires a subdivider or developer to establish an association, the municipality may not require an association to adopt a regulation that is more restrictive than existing municipal regulations. (Sec. 1)
