Overview

Specifies candidates must appear on a separate nonpartisan primary ballot, in specific circumstances, and details where the name of the candidates must be placed.

History

Nonpartisan candidates are required to fill out a separate nomination petition from partisan candidates (A.R.S. § 16-314).

Any person desiring to become a candidate at any nonpartisan election must at the time of filing be a qualified elector of the county, city, town or district and not less than 120 nor more than 150 days before election sign and file a nomination paper (A.R.S. § 16-311).

Provisions

1.   Specifies candidates must appear on a separate nonpartisan ballot, if there is more than one candidate for the same office that has filed a nomination petition and qualifies for the ballot, if the following apply:

a)   there is at least one partisan candidate for the same office who has filed a nomination paper and petition; and

b)   the aforementioned candidate qualifies to appear on the primary election ballot for a political party entitled to continued representation on the ballot. (Sec. 1)

2.   Specifies the candidate, in the primary election of the previous provision, who receives the highest number of votes for an office advances to the general election as the nonpartisan nominee. (Sec. 1)

3.   Establishes that if more than one candidate file for nomination for the same office, as mentioned above, the nonpartisan candidate who received the highest number of votes for that office must have their name placed on the ballot below that of the recognized parties. (Sec. 2)

4.   Instructs legislative council to prepare conforming legislation for next session. (Sec. 3)
