Overview
Establishes the Ballistic Shield Fund (Fund) under the Arizona Department of Public Safety (DPS) and appropriates $2,000,000 from the state General Fund (GF) in fiscal year (FY) 2026 to the Fund.
History
DPS administers a variety of funds including the Public Safety Equipment Fund (Equipment Fund). Monies come from assessments collected from laws relating to driving under the influence, civil traffic violations, and motor vehicle statutes. The first $1,200,000 deposited into the Equipment Fund each fiscal year from laws relating to driving under the influence are continuously appropriated for vehicles, protective armor, electronic stun devices and other safety equipment. After the first $1,200,000, the State Treasurer must deposit the remaining of the specified monies into the state GF. Monies collected from laws relating to civil traffic violations and motor vehicle statutes are subject to legislative appropriation and must be used for vehicles, protective armor, electronic stun devices and other safety equipment (A.R.S. §§ 12-116.04 and 41-1723).
Provisions
1. Establishes the Fund, consisting of legislative appropriations, administered by DPS to distribute monies to law enforcement agencies in Arizona to purchase ballistic shields capable of protecting against high-powered firearms. (Sec. 1)
2. Appropriates $2,000,000 from the state GF in FY 2026 to the Fund. (Sec. 2)
3. Requires law enforcement agencies in Arizona that receive Fund monies to provide a one-half match of the monies distributed. (Sec. 1)
4. Defines law enforcement agencies. (Sec. 1)
5. States that Fund monies are continuously appropriated and exempt from lapsing. (Sec. 2)
