Overview
Raises the jurisdictional limit of small claims court from $3,500 to $7,500.
History
Justices of the Peace have original jurisdiction in all civil cases involving $10,000 or less, exclusive of interest, costs and awarded attorney fees when legally authorized (A.R.S. § 22-201).
The Small Claims Division of the inferior justice courts resolves civil actions in which the case issue does not exceed $3,500 in an inexpensive, informal and speedy manner. Such civil actions include debt, damage, tort, injury and personal property claims. Exclusions from the $3,500 small-claims cap, include: interest, costs, actions in which a party seeks to disaffirm, avoid or rescind a contract or actions that seek equitable relief (A.R.S. §§ 22-501, 22-503).
Provisions
1. Increases the jurisdictional limit for the small claims division of the justice courts, from $3,500 to $7,500. (Sec. 1)
