SB 1030: veterinarian malpractice actions; damages

Overview

Prescribes damages that can be awarded to a person that prevails in a malpractice action against a veterinarian.

History

Statute established the Veterinary Board to protect the public from unlawful, incompetent, unqualified, impaired or unprofessional practitioners of veterinary medicine.  Their duties include regulating disciplinary actions, investigating charges of violations and establishing penalties for specified wrongdoings. Malpractice is defined as treatment in a manner contrary to accepted practices and with injurious results (A.R.S. §§ 32-2201, 32-2207).

Provisions

1.   Allows a person to receive the following damages if the person prevails in a malpractice action against a veterinarian:

a)   the fair market value of the domestic animal if deceased; and

b)   the cost of all reasonable and necessary veterinary expenses for the domestic animal resulting from the malpractice. (Sec. 1)
