Summary of the Strike-Everything Amendment to SB 1061

Overview

Increases the daily subsistence payment amounts for legislators who reside within Maricopa County.

History

Arizona legislators are paid for subsistence during a regular and special session and on days when the member acts on a legislative matter. For the first 120 days of a regular session, a legislative member whose permanent residence is within Maricopa County is paid $35 daily. After the first 120 days of a regular session, the daily subsistence payment for members who reside within Maricopa County goes down to $10. 

For a legislative member whose permanent residence is outside Maricopa County, for the first 120 days of a regular session, they are paid 100% of the average of the six months of the annual federal per diem rate for Maricopa County, including lodging as determined by the United States General Services Administration (U.S. GSA). The Director of the Arizona Department of Administration (ADOA) is required to determine this amount annually. The amount annually determined by the Director of AODA is currently $269. After the first 120 days of a regular session, the daily subsistence payment decreases and a member who resides outside of Maricopa County is paid 50% of the amount annually determined by the Director of ADOA (A.R.S. § 41-1104).

Federal law gives the administrator of the U.S. GSA authority to determine per diem rates for employees traveling on official business (5 USC § 5702). Federal per diem includes an allowance for lodging, meals and incidental expenses and varies by month, locality or county (U.S. GSA Rates for Maricopa County).

Provisions

1.   Increases the daily subsistence payment for a legislative member who resides in Maricopa County to:

a)   80% of the amount annually determined by the Director of ADOA for the first 120 days of a regular session, rather than $35;

b)   40% of the amount annually determined by the Director of ADOA after the first 120 days of a regular session, rather than $10. (Sec. 1)
