SB1107: motorcycle safety fund continuation

Overview
Continues the Motorcycle Safety Fund (Fund) and requires any fee assessment or other levy authorized by law or administrative rule that is collected and deposited to be held in trust.
History
Laws 1996, Chapter 76 established the Fund consisting of monies deposited from motorcycle registration fees and monies from gifts, grants and other donations. The Director of the Governor's Office of Highway Safety (Director) must administer the Fund. On notice from the Director, the State Treasurer must invest and divest monies in the Fund and monies earned from investment must be credited to the Fund. Up to 10% of Fund monies may be used for administrative costs. Monies in the Fund are subject to legislative appropriation and are exempt from lapsing. The Director of the Arizona Department of Transportation must deposit $1 of each motorcycle registration fee into the Fund through June 30, 2025.
Subject to legislative appropriation, the Director must use monies deposited in the Fund to implement and support voluntary motorcycle education, awareness, training and other programs and may use the monies to cover the cost of materials for motorcycle safety, education and awareness programs (A.R.S. § 28-2010).
Provisions
1. Continues, indefinitely, the Fund by deleting the June 30, 2025, expiration date. (Sec. 1)
2. Requires any fee assessment or other levy that is authorized by law or administrative rule that is collected and deposited in the Fund to be held in trust. (Sec. 1)
3. Stipulates the monies in the Fund may only be used for the prescribed purposes of the Fund. (Sec. 1)
4. Prohibits monies in the Fund from being appropriated or transferred by the Legislature to fund the general operations of this state or otherwise meet the obligations of the state General Fund. (Sec. 1)
5. Exempts any fee assessment in the Fund from taxes or other levies imposed relating to taxation or taxation on income statutes. (Sec. 1)
6. Contains a retroactivity clause of June 30, 2025. (Sec. 2)
