SB 1134: ADWR; application; review; time frames

Overview

Establishes a time frame for the Arizona Department of Water Resources (ADWR) to make determinations on applications for certificates or designations of assured water supply.

History

State agencies that issue licenses are required to adopt rules that establish an overall timeframe for the agency to grant or deny each license. Agencies are additionally required to issue a written notice to applicants of administrative completeness or deficiencies for an application within the administrative completeness review time frame. If an agency determines that an application is not administratively complete it is an appealable agency action and would entitle the applicant to an adjudication on the merits of the completeness of the application, applications submitted to ADWR are not appealable actions (A.R.S. §§ 41- 1073 and 41-1074).

Provisions

1.   Provides that applications submitted to ADWR may be appealed if the agency determines the application not administratively complete. (Sec. 1)

2.   Establishes time frames for the Director of ADWR to make determinations for an application for a new or modified certificate, designation, or analysis of assured water supply within:

a)   30 days or less for the administrative completeness review;

b)   90 days or less for the substantive review; and

c) 120 days or less for the overall time frame. (Sec. 2)

3.   Defines, by reference:

a)   administrative completeness review time frame;

b)   overall time frame; and

c) substantive review time frame. (Sec. 2)

4.   Makes technical and conforming changes. (Sec. 2)
