Overview
An emergency measure that precludes a local government from enacting any ordinance or rule that prohibits construction activities during specified times of certain months.
History
Current statute enumerates the general powers of cities, towns and counties. These general powers include the following authorities: 1) buying, selling and leasing property; 2) providing for the construction or rehabilitation of housing development projects or areas; 3) preparing and adopting a comprehensive long-range general plan for the orderly growth and development of the municipality or county; 4) adopting zoning ordinances and codes to protect the health, safety and welfare; 5) regulating the subdivision of all lands within its corporate limits; and 6) issuing building permits (Title 9, Chapter 4, A.R.S., Title 11, Chapter 6, A.R.S.).
Provisions
1. Prohibits, for construction work that is being performed in accordance with a validly issued building permit, a municipality or county from enacting any ordinance, rule or regulation that restricts or prohibits general construction activities between May 1 and October 15 of each year between 5:00 A.M. and 7:00 P.M. each business day and between the hours of 7:00 A.M. and 7:00 P.M. on Saturday. (Sec. 1, 2)
2. Asserts that a municipality or county must allow concrete to be poured at least one hour before the time that general construction activities are regularly scheduled to begin. (Sec. 1, 2)
3. Contains an emergency clause. (Sec. 3)
