Overview
Creates a new requirement that individuals who own, or are responsible for, a dog that bites someone must provide contact information to the bite victim.
History
Arizona law establishes strict liability for dog owners whose dogs bite another individual who is lawfully in a public or private place, including the dog owner's property. The owner is liable regardless of the dog’s past behavior or the owner's knowledge of any aggressiveness. Governmental agencies are exempt from liability for bites by dogs used in military or police work under certain conditions, including that the dog was acting within the scope of specific law enforcement functions and the agency has a formal use policy (A.R.S. § 11-1025).
Provisions
1. Requires the owner or person responsible for the care of a dog that bites someone to provide the owner's contact information to the person bitten. (Sec. 1)
2. Makes conforming changes. (Sec. 1)
