Overview

Continues the Board of Executive Clemency (BOEC) for five years.

History

The BOEC possesses exclusive power to pass on and recommend reprieves, commutations, paroles and pardons to the Governor. The BOEC consists of five members, appointed by the Governor for five-year terms, based upon professional or educational qualifications and a demonstrated interest (A.R.S. §§ 31-401 and 31-402).

The BOEC is set to terminate on July 1, 2025. The Senate Judiciary and Elections Committee of Reference (COR) reviewed the Auditor General's performance audit and sunset review, received public testimony and recommended that the BOEC be continued (COR Report; A.R.S. § 41-3025.13).

Provisions

1.   Continues, retroactive to July 1, 2025, the BOEC until July 1, 2030. (Sec. 2, 4)

2.   Repeals the BOEC on January 1, 2031. (Sec. 2)

3.   Contains a purpose clause. (Sec. 3)
