Overview
Directs the Arizona Department of Administration (ADOA) to lease the Marana prison site to the United States (U.S.) government for $1 per year to house individuals held by the U.S. government for immigration violations.
History
DOC encompasses the institutions, facilities and programs that are part of the statewide adult correctional system. DOC also provides supervisory staff for all matters relating to institutionalization rehabilitation and community supervision of all adult offenders (A.R.S. § 41-1602).
In November 2023, it was announced that the private prison contract for the management of the Arizona State Prison–Marana, a minimum security state facility, would not be renewed going into 2024 (Governor's Office).
Provisions
1. Requires ADOA to lease the Marana prison site to the U.S. government or a private contractor of the U.S. government for $1 per year to house individuals held by the U.S. government for immigration violations. (Sec. 1)
2. Requires the lease to be for an initial term of four years with the option to extend the lease for two additional years. (Sec. 1)
3. Directs the U.S. government or a private contractor of the U.S. government to maintain the Marana prison site for the full term of the lease in the same or better condition as received at the beginning of the lease. (Sec. 1)
4. States that any repairs, refurbishments or replacements must be made in accordance with generally accepted industry standards. (Sec. 1)
5. Stipulates that the lease agreement must include a provision that allows ADOA to terminate the lease and take back control of the Marana prison site if both of the following are met:
a) ADOA provides written notice to the leaseholder at least 12 months prior to terminating the lease; and
b) ADOA demonstrates that the Marana prison site beds are needed to house inmates in custody of Arizona or ADOA has an agreement for a purchaser of the Marana prison site. (Sec. 1)
6. Repeals on October 1, 2032. (Sec. 1)
