SB 1307: advanced air mobility infrastructure

Overview
Requires the Arizona Department of Transportation (ADOT), beginning July 1, 2026, to develop a statewide plan or update the statewide aviation plan to include vertiports and electric aircraft charging stations and the infrastructure needs of advanced air mobility (AAM). Prescribes requirements on AAM infrastructure.
History
Exclusive control and jurisdiction over state highways, state routes, state-owned airports and all state-owned transportation systems or modes are vested in ADOT. Statute regulates ADOT jurisdiction and duties, including registering motor vehicles and aircraft, licensing drivers, collecting revenues, enforcing motor vehicle and aviation statutes and performing related functions and doing multimodal state transportation planning, cooperating and coordinating transportation, planning with local governments and establishing an annually updated priority program of capital improvements for all transportation modes (A.R.S. § 28-332).
ADOT must cooperate with all state, local and federal organizations to encourage and advance the safe and orderly development of aviation in this state (A.R.S. § 28-8242).
Aircraft operating in this state must conform to design, construction and airworthiness standards prescribed by the United States or the appropriate federal agency for the navigation of aircraft subject to its jurisdiction. It is unlawful for a person to navigate an aircraft in this state unless it is licensed and registered by the appropriate agency of the United States in the manner prescribed by regulations of the United States or the appropriate federal agency (A.R.S. § 28-8272).
The governing body of a city or town or the board of supervisors of a county may acquire, establish, construct, own, control, lease, equip, improve, maintain, operate and regulate airports for the use of aircraft within or outside the limits of the city, town or county (A.R.S. § 28-8411).
To prevent an airport hazard, a political subdivision that has an airport hazard area within its territorial limits may adopt, administer and enforce airport zoning regulations for the airport hazard area, under the police power, in the manner of the conditions prescribed. (A.R.S. § 28-8464).
Provisions
1. Directs ADOT, beginning July 1, 2026, to:
a) develop a statewide plan or update the statewide aviation plan to include vertiports, electric aircraft charging stations and the infrastructure needs of AAM through consultation with political subdivisions of this state owning or controlling an airport, commercial air carriers, the Federal Aviation Administration (FAA) and any other relevant stakeholders;
b) designate an expert in AAM within ADOT as a resource for local and regional jurisdictions that are developing or implementing AAM, including an electric powered lift aircraft and electric aircraft. The person must establish working relationships with political subdivisions of this state owning or controlling an airport, commercial air carriers, the FAA, the United States Department of Transportation and any other relevant stakeholders; and
2. Applies AAM regulation only to AAM aircrafts, including an eCTOL, eVTOL and a powered lift aircraft, that have a gross takeoff weight of 300 pounds or more and have the capability of carrying passengers or cargo. (Sec. 1)
3. Requires the Arizona Commerce Authority to provide educational materials to local and regional jurisdictions on the benefits of electric powered aircrafts and AAM. (Sec. 2)
