Overview
Appropriates $20,000,000 from the Consumer Restitution and Remediation Revolving Fund (Fund) in FY 2026 to the Attorney General (AG) for grants to county sheriffs that continue or establish a Coordinated Reentry Planning Services Program (Program).
History
Counties may establish a Program to assess individuals who are booked into county jail and connect them with behavioral health and substance use disorder treatment providers early in the criminal justice process. Programs must: 1) allow entities to access a cross-system recidivism tracking database; 2) allow entities to work in conjunction with counties, cities, and towns to establish an information exchange mechanism that includes reentry planning efforts; 3) allow county and community collaborative efforts to be established for jail reentry planning services that include treatment, peer support, housing, transportation and employment services; 4) establish working agreements with coalition partners to record postrelease treatment engagement; and 5) use the cross-system recidivism tracking database to record statistics for identified needs, referrals and future recidivism of reentry coordination participants (A.R.S. § 11-392).
The Fund is administered by the AG and consists of two subaccounts. The Consumer Remediation Subaccount receives funds from lawsuits where the AG wins a judgment or settlement due to violations of consumer protection. At the direction of the AG, the State Treasurer may invest monies in the Fund, with investment earnings credited to the appropriate subaccount (A.R.S. § 44-1531.02).
Provisions
1. Requires any county receiving state funds for a Program to issue a report to the President of the Senate, the Speaker of the House of Representatives and the Joint Legislative Budget Committee by December 1 annually beginning in 2027. (Sec. 1)
2. Outlines required contents of the report, including:
a) the percentage of inmates with specified risk factors;
b) the incidence of recidivism; and
c) the percentage of released individuals connected with specified services. (Sec. 1)
3. Appropriates $20,000,000 from the Consumer Restitution Subaccount of the Fund in FY 2026 for the AG to issue two-year grants to county sheriffs to continue or establish a Program. (Sec. 2)
4. Prohibits the AG from allocating more than $3,000,000 to an individual grant recipient over the two-year grant cycle and granting awards to Maricopa and Pima counties. (Sec. 2)
5. Allows up to $2,000,000 to be available for a statewide database to accommodate additional counties over the two-year grant cycle. (Sec. 2)
6. Lists requirements that a county must demonstrate by the end of the grant cycle, including dedicated Program staff within the county jail and a commitment to local contributions to the Program. (Sec. 2)
