SB 1343: probation supervision; transfer

Overview

Authorizes a probationer to make a written request at any time to transfer their probation to another county in Arizona.

History

At the time of sentencing or disposition a probationer can make a written request to the supervising probation department for a courtesy transfer of their probation to another county in this state if the probationer: 1) intends to reside in that county; and 2) provides proof of family caregiver obligations or actual or offered employment or housing that will assist in the probationer's positive behavioral change. Upon receipt of the request, the supervising probation department must: 1) confirm the probationer's employment, housing or family caregiving plans; 2) review any victim safety concerns; and 3) submit the request to the receiving county.  After the receiving county has received and verified the written request, they must provide the sending probation department with permission for the probationer to proceed to the county.  Once the probationer resides in the new county they may not be sent back to the original county except by a court order or revocation hearing (A.R.S. § 13-901).
