Summary of the Strike-Everything Amendment to SB 1350

Overview

Restricts, beginning December 31, 2028, specified individuals from using unmanned aircrafts made in China to collect data on critical infrastructure unless the unmanned aircraft has outlined security software protection measures set in place.

History

An unmanned aircraft is an aircraft, including an aircraft commonly known as a drone, that is operated without the possibility of direct human intervention within or on the aircraft. It is unlawful for a person to operate a model aircraft or civil unmanned aircraft if the operation is prohibited by federal law or interferes with law enforcement, firefighters or emergency service operations. A violation of this law is a class 1 misdemeanor (A.R.S. § 13-3729).

Provisions

1. Prohibits, beginning December 31, 2028, state agencies and independent contractors from using or operating unmanned aircraft manufactured or assembled by a company domiciled in the People's Republic of China to collect data on any restricted infrastructure in Arizona. (Sec. 1)

2. Allows state agencies and independent contractors to use unmanned aircrafts manufactured by a company domiciled in the People's Republic of China if outlined security software protection measures are set in place. (Sec. 1)

3. Requires an independent contractor to annually verify that the security software follows all applicable standards established by the Arizona Department of Public Safety (DPS) and the Arizona Department of Homeland Security (AZDOHS). (Sec. 1)

4. Instructs DPS and AZDOHS to designate critical infrastructure in Arizona as restricted on a site-specific basis. (Sec. 1)

5. States the critical infrastructure may only be designated by category, type of facility or installation as necessary to effectuate this legislation. (Sec. 1)

6. Requires DPS and AZDOHS, when determining the designation of restricted critical infrastructure, to consider:

a) the sensitivity of the data accessible by unmanned aircraft mounted cameras and sensors;

b) the availability of similar data from sources other than unmanned aircrafts; and

c) the efficacy, cost and availability of unmanned aircraft models produced by companies not domiciled in the People's Republic of China. (Sec. 1)

7. Stipulates that this legislation does not apply to AZDOHS, DPS, a municipal law enforcement agency, a county sheriff's department or any third party delivering data collection services using unmanned aircraft systems to any law enforcement agency. (Sec. 1)
