SB 1368: appropriations; public safety equipment

Overview

Appropriates specified monies from the Peace Officer Training Equipment Fund (Fund) in FY 2026 to outlined entities for public safety equipment.

History

The Fund is administered by the Arizona Department of Public Safety for peace officer equipment. Fund monies consist of: 1) a portion of a surcharge collected for a court-authorized diversion program; 2) civil penalties imposed and collected for civil traffic violations; or 3) a fine, penalty or forfeiture for a criminal violation of the motor vehicles statutes or any local ordinance relating to the stopping, standing or operation of a vehicle. Fund monies do not revert to the state General Fund at the end of each fiscal year, are exempt from lapsing and are subject to legislative appropriations (A.R.S. §§ 12-114, 12-116.10 and 41-1731).

The Peace Officer Training Equipment Fund Advisory Commission (Commission) by December 1 of each fiscal year, must submit written recommendations to outlined entities on the allocation each fiscal year of monies in the Fund. Commission members serve three-year terms and consist on the following members: 1) one member appointed by the Senate President; 2) one member appointed by the Speaker of the House of Representatives; 3) the Arizona Department of Public Safety Director or their designee; 4) one member appointed by the Arizona Association of Chiefs' of Police; 5) one member appointed by the Arizona Sheriffs' Association; 6) one member who is appointed by the Arizona State Troopers Association; and 7) one member appointed by the Arizona Police Association (A.R.S. § 41-1732).

Provisions

1.   Appropriates specified amounts from the Fund in FY 2026 to distribute to the following entities for the following purpose:

a)   $200,000 to Flagstaff Police Department (PD) for pepper ball and pepper ball weapons;

b)   $328,000 to Flagstaff PD for a public safety training simulator; and

c) $700,000 to Glendale PD for two public safety training simulators. (Sec. 1)
