SB 1368: appropriations; public safety equipment

Overview

Appropriates specified monies from the Peace Officer Training Equipment Fund (Fund) in FY 2026 to outlined entities for public safety equipment.

History

The Fund is administered by the Arizona Department of Public Safety for peace officer equipment. Fund monies consist of: 1) a portion of a surcharge collected for a court-authorized diversion program; 2) civil penalties imposed and collected for civil traffic violations; or 3) a fine, penalty or forfeiture for a criminal violation of the motor vehicles statutes or any local ordinance relating to the stopping, standing or operation of a vehicle. Fund monies do not revert to the state General Fund at the end of each fiscal year, are exempt from lapsing and are subject to legislative appropriations (A.R.S. §§ 12-114, 12-116.10 and 41-1731).

The Peace Officer Training Equipment Fund Advisory Commission (Commission) by December 1 of each fiscal year, must submit written recommendations to outlined entities on the allocation each fiscal year of monies in the Fund. Commission members serve three-year terms and consist on the following members: 1) one member appointed by the Senate President; 2) one member appointed by the Speaker of the House of Representatives; 3) the Arizona Department of Public Safety Director or their designee; 4) one member appointed by the Arizona Association of Chiefs' of Police; 5) one member appointed by the Arizona Sheriffs' Association; 6) one member who is appointed by the Arizona State Troopers Association; and 7) one member appointed by the Arizona Police Association (A.R.S. § 41-1732).

Provisions

1.   Appropriates specified amounts from the Fund in FY 2026 to distribute to the following entities for the following purposes:

a)   $200,000 to Flagstaff Police Department (PD) for pepper ball and pepper ball weapons;

b)   $328,000 to Flagstaff PD for a public safety training simulator; and

c) $700,000 to Glendale PD for two public safety training simulators. (Sec. 1)

2.   Exempts the appropriation from lapsing. (Sec. 1)

Amendments

Committee on Public Safety & Law Enforcement

1.   Removes Flagstaff PD's $200,000 appropriation for pepper ball and pepper ball weapons.

2.   Reduces Glendale PD's appropriation for public safety training simulators to $660,000.

3.   Appropriates $328,000 to Yavapai County Sheriff's Office for public safety training simulators.

4.   Appropriates the following amounts from the Fund in FY 2026 to distribute to the following entities for pepper ball equipment:

a)   $53,645 to Navajo County Sheriff's Office;

b)   $20,850 to Page PD;

c) $24,624 to Benson PD;

d)   $121,434 to Yuma PD;

e)   $103,487 to Queen Creek PD;

f) $30,337 to Maricopa PD;

g)   $200,000 to Tucson PD;

h)   $68,035 to Apache County Sheriff's Office;

i) $7,495 to Show Low PD;

j) $18,920 to Pinetop-Lakeside PD;

k)   $25,412 to Tempe PD;

l) $34,323 to Douglas PD;

m)  $22,474 to Nogales PD;

n)   $12,735 to Coconino County Sheriff's Office;

o)   $33,311 to Clarkdale PD;

p)   $87,651 to Bullhead City PD;

q)   $39,049 to La Paz County Sheriff's Office;

r) $97,319 to Flagstaff PD;

s)   $32,867 to St. Johns PD;

t) $52,879 to Surprise PD;

u)   $39,574 to Tonto Apache PD;

v)   $54,600 to Arizona State University PD;

w) $36,224 to Yuma County Sheriff's Office;

x)   $74,828 to Goodyear PD;

y)   $18,758 to San Luis PD;

z)   $63,080 to Pinal County Sheriff's Office;

aa) $13,807 to Graham County Sheriff's Office;

5.   Appropriates various amounts from the Fund in FY 2026 to distribute to the following entities for license plate readers:

a)   $21,000 to City of Apache Junction;

b)   $30,000 to Town of Prescott Valley;

c) $45,000 to City of Surprise;

d)   $115,000 to Coconino County;

e)   $60,000 to Yavapai County;

f) $12,000 to City of Cottonwood

g)   $30,000 to City of Prescott

h)   $100,000 to Pinal County Attorney's Office; and

i) $9,000 to City of San Luis.

6.   States that the Legislature intends that the allocated training simulator be used to teach de-escalation tactics.
