Summary of the Strike Everything Amendment to SB 1444

Overview

Expands the projects that a county improvement district (District) may undertake, if located in a subsequent active management area (AMA).

History

Residents in a community in an unincorporated area of a county may choose to form a county improvement district to fund infrastructure improvements including roadway paving, water or sewer services, street lighting, transportation or pedestrian infrastructure and community parks (A.R.S. § 48-909).

The improvements being undertaken by the District are paid for by the issuance of an improvement bond in the name of the District and represent the cost and expense of the work or improvement constructed. The bond is paid for through a fund which is an accumulation of special assessments placed on the properties within the District. All sums collected from the special assessments shall be placed in the special fund and shall be used for no other purpose than payment of the principal and interest of the bonds (A.R.S. § 48-933).

Provisions

1.   Expands the definition of waterworks to include standpipes. (Sec. 1)

2.   Modifies the purpose an improvement district may be established to include constructing and operating a domestic water delivery system for the purpose of delivering water through water hauling, if located in a subsequent AMA. (Sec. 2)

3.   Adds wells and standpipes to the list of projects to the list of projects an improvement district may undertake. (Sec. 3)

4.   Includes water hauling as a means of delivering water in a subsequent AMA in the existing authorized actions for an improvement district. (Sec. 3)

5.   Allows an improvement district, that is formed in a subsequent AMA for the purpose of water hauling, to exercise eminent domain for limited prescribed purposes. (Sec. 3)

6.   Makes technical and conforming changes. (Sec. 1, 2 and 3)
