SB 1515: appropriations; interoperability fund; equipment fund

Overview
Transfers unexpended and unencumbered monies from the School Safety Interoperability Fund (Fund) for specified cities and counties to the Peace Officer Training Equipment Fund.
History
The Fund is administered by the Arizona Department of Administration consisting of continuously appropriated monies by the Legislature. Fund monies must be distributed to a county sheriff, city or town police department that establishes a school safety program that meets outlined criteria (A.R.S. § 41-1733).
The Peace Officer Training Equipment Fund is administered by the Arizona Department of Public Safety for peace officer equipment. Fund monies consist of: 1) a portion of a surcharge collected for a court-authorized diversion program; 2) civil penalties imposed and collected for civil traffic violations; or 3) a fine, penalty or forfeiture for a criminal violation of the motor vehicles statutes or any local ordinance relating to the stopping, standing or operation of a vehicle. Fund monies do not revert to the state General Fund at the end of each fiscal year, are exempt from lapsing and are subject to legislative appropriations (A.R.S. §§ 12-114, 12-116.10 and 41-1731).
The FY 2023 General Appropriations Act appropriated the following amounts to the specified entities from the Fund: 1) $2,000,000 to Tucson Police Department (PD); 2) $1,350,000 to Yuma PD; and 3) $1,250,000 Coconino County Sheriff.
Provisions
1. Reverts unexpended and unencumbered monies from the Fund to the Cities of Tucson and Yuma and Coconino County back to the Fund. (Sec. 1)
2. Transfers reverted monies to the Peace Officer Training Equipment Fund. (Sec. 1)
