SB 1517: off-highway vehicles; weight

Overview

Allows the Arizona Department of Transportation (ADOT) to issue a temporary general use registration, that allows an off-highway vehicle (OHV) to be operated for not more than 30 days, to a person who is a nonresident who owns an OHV titled in another state and otherwise meets OHV requirements. Extends the OHV study committee (study committee) by two years.

History

A person must not operate or allow the operation of an all-terrain vehicle or an OHV in this state without either a resident or nonresident OHV user indicia issued by ADOT if the all-terrain vehicle or OHV is designed by the manufacturer primarily for travel over unimproved terrain and has an unladen weight of 2,500 pounds or less. A person must apply to ADOT for a resident or nonresident OHV user indicia by submitting an application prescribed by ADOT and a user fee for the indicia in an amount to be determined by the Director of ADOT in cooperation with the Director of the Arizona Game and Fish Department and the Arizona State Parks board.  The resident or nonresident OHV user indicia is valid for one year from the date of issuance and may be renewed (A.R.S. § 28-1177)

Laws 2022, Chapter 148 established the study committee. The study committee is required to collect and study information from stakeholders and the public regarding OHV issues in this state and must submit an annual report on the study committee's activities and recommendations for legislative or administrative action. The study committee will be repealed on June 1, 2025.

An OHV is a motorized vehicle that is operated primarily off of highways and that is designed, modified or purpose-built primarily for recreational non-highway all-terrain travel. An OHV includes a tracked or wheeled vehicle, utility vehicle, all-terrain vehicle, motorcycle, four wheel drive vehicle, dune buggy, sand rail, amphibious vehicle, ground effects or air cushion vehicle and any other means of land transportation deriving motive power from a source other than muscle or wind (A.R.S. § 28-1171).

Provisions

1.   Stipulates that ADOT may issue a temporary general use registration that allows an OHV to be operated for not more than 30 days, to a person who is a nonresident who owns an OHV titled in another state and otherwise meets OHV requirements. (Sec. 1)

2.   Continues the study committee for two more years. (Sec. 2)

3.   Exempts a person, who owns an OHV titled in another state and otherwise meets specified requirements, from the requirement that a registering officer is restricted to issue more than one temporary general use registration for a vehicle in a 12-month period. (Sec. 1)

4.   Repeals the study committee on June 1, 2027. (Sec. 2)

5.   Contains a retroactive clause of June 1, 2025. (Sec. 3)
