Summary of the Strike-Everything Amendment to SB 1706

Overview

Exempts the federal government from the state's requirement that any state contract may be terminated within three years under specified circumstances.

History

Any political subdivision in the state is permitted to cancel any contract without penalty within three years after its execution should a party from that political subdivision be found to be an employee of any other party to the contract. Cancellation of the contract is effective upon written notice from the Governor, or the Chief Executive Officer or governing body of the political subdivision. The political subdivision can recoup any fee or commission paid or due to any person significantly involved in the contract from any other party to the contract. It is required that notice of this rule be included in every contract to which it applies (A.R.S. § 38-511).
