SCR1006: state trust land; land exchanges

Overview
Subject to voter approval, requires the exchange of state lands for other lands to be approved by the Legislature and the Governor by a joint resolution, rather than by the qualified electors of Arizona in the form of a referendum.
History
State land may be exchanged for public land in Arizona to improve the management of state lands for the purpose of sale or lease or conversion to public use of state lands or to assist in preserving and protecting military facilities in Arizona (A.R.S. § 37-604) (Ariz. Const. art. 10 § 12).
The Arizona State Land Department (Department) must adopt rules governing the application and procedure for the exchange of state lands. State land may not be exchanged unless:
1) the exchange is in the best interest of the state land trust;
2) the public notice of the proposed exchange includes outlined information;
3) the public hearings are held at the state capital and in a location of general accessibility in the vicinity of the state lands being exchanged; and
4) the exchange is approved by the affirmative vote of a majority of the qualified electors of Arizona by referendum at the next general election (Ariz. Const. art. 10 § 12).
Provisions
1. Authorizes the Legislature to provide a process for exchanging lands for other lands, rather than public lands, in Arizona.
3. Instructs the Secretary of State to submit this proposition to the voters at the next general election.
