cruelty to working animals; classification

(NOW: county animal control agencies; bequests)

Purpose

Allows a county board of supervisors to receive any gift, bequest or devise for the county enforcement agent, county animal control agency or county pound.

Background

Statute allows the county board of supervisors to perform a variety of actions, including:
1) supervising the official conduct of all county officers charged with assessing, collecting, safekeeping, managing or distributing of public revenues; 2) dividing the counties into districts or precincts, changing the districts or precincts and creating other districts or precincts;
3) establishing, abolishing and changing election precincts, appointing inspectors and judges of elections, canvassing election returns and declaring the result of elections; and 4) purchasing real property for public purposes, provided that final payment is made not later than five years after the date of purchase (A.R.S. § 11-251).

The county board of supervisors, when acting as the board of directors for the county free library district, is allowed to receive any gift, bequest or device for the county free library or any branch thereof (A.R.S. § 11-914).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Allows a county board of supervisors to receive any gift, bequest or devise for the county enforcement agent, county animal control agency or county pound, in a county that has a designated county enforcement agent or that operates a county pound.

2.   Specifies that a county enforcement agent is the person in each county who is responsible for enforcing rules regarding animal control.

3.   Becomes effective on the general effective date.
