police reports; victims; prosecuting agency

Purpose

            Broadens the responsibility of providing outlined information to crime victims to include the charging prosecutorial agency.

Background

A victim of a criminal offense that is a part I crime under the statewide Uniform Crime Reporting (UCR) Program, or the victim's attorney on behalf of the victim or an immediate family member of the victim if the victim is killed or incapacitated, has the right to receive one copy of the police report and video recordings from the investigating law enforcement agency at no charge and, on request of the victim, the court or the court clerk must provide, at no charge, the minute entry or portion of the record of any proceeding in the case that arises out of the offense committed against the victim and that is reasonably necessary to pursue a claimed victim's right (A.R.S.
§ 39-127
).

A victim of a crime must be notified of: 1) the victim's rights under the victims' bill of rights; 2) the availability of crisis intervention services and emergency and medical services; 3) in cases involving domestic violence, the procedures and resources available for the protection of the victim; 4) the names and telephone numbers of public and private victim assistance programs, including the county victim compensation program and programs that provide counseling, treatment and other support services; 5) the police report number, other identifying case information and the law enforcement agency's telephone number for the status of the case; and
6) whether the suspect is an adult or juvenile (‎A.R.S. § 8-386).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Includes a charging prosecutorial agency as an agency that must provide free copies of police reports, video recordings and transcripts for crime victims.

2.   Specifies that a victim's immediate family member may receive one copy of video recordings from the charging prosecutorial agency, in addition to the law enforcement agency, at no charge if the victim is killed or incapacitated.

3.   Defines domestic violence offense.

4.   Makes technical and conforming changes.

5.   Becomes effective on the general effective date.
