motorcycle safety fund continuation

Purpose

Continues the deposit of $1 of each motorcycle registration fee into the Motorcycle Safety Fund (Fund), holds Fund monies in trust and immunizes Fund monies from being used for any purpose other than as prescribed.

Background

The Director of the Governor's Office of Highway Safety (Director) administers the Fund which consists of a prescribed portion of motorcycle registration fee collections, gifts, grants and other donations. Up to 10 percent of monies in the Fund may be used for administrative costs. The Director must use Fund monies to implement and support voluntary motorcycle education, awareness, training and other programs and may use Fund monies to cover the cost of materials for motorcycle safety, education and awareness programs. Fund monies are subject to legislative appropriation and are exempt from lapsing.

The fee for a motorcycle registration is $9. Of each motorcycle registration fee collected, $1 is deposited into the Fund by the Director of the Arizona Department of Transportation (ADOT). The authorization for deposits of $1 of each motorcycle registration fee to the Fund sunsets on June 30, 2025 (A.R.S. ยงยง 28-2003 and 28-2010).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Removes the expiration date of July 1, 2025, for requiring the Director of ADOT to deposit $1 of each motorcycle registration fee in the Fund.

2.   Requires any fee, assessment or other levy that is authorized by law or administrative rule and is collected and deposited in the Fund to be held in trust, excluding statutorily imposed taxes and levies.

3.   Asserts that Fund monies may only be used for purposes prescribed by statute.

4.   Stipulates that Fund monies may not be appropriated or transferred by the Legislature to fund the general operations of the state or otherwise meet the obligations of the state General Fund.

5.   Makes technical changes.

6.   Becomes effective on the general effective date, retroactive to June 30, 2025.
