ARIZONA STATE SENATE

health profession regulatory boards; membership
Purpose
Restructures the statutory membership of certain health profession regulatory boards (health board) to hold public members as a majority, rather than professional members.
Background
A health board is any board that regulates one or more health professional in Arizona. The primary purpose of a health board is to protect the public from unlawful, incompetent, unqualified, impaired or unprofessional conduct by practitioners of certain health occupations and professionals. In order for an individual to practice or perform a regulated health occupation or profession or use certain occupational or professional titles in Arizona, a person must meet certain qualifications and apply to the designated health board for the license, certificate or authorization (A.R.S. Title 32 and Title 36).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
Podiatry Board
1. Decreases, from three to two, the number of licensed podiatrists on the Podiatry Board.
2. Increases, from two to three, the number of laypersons on the Podiatry Board.
3. Decreases, from three to two, the number of licensed chiropractors on the Chiropractic Board.
4. Increases, from two to three, the number of consumer members on the Chiropractic Board.
5. Restructures the BODEX to a 7-member board, rather than an 11-member board.
6. Decreases, from six to one, the number of licensed dentists on the BODEX.
7. Decreases, from two to one, the number of licensed dental hygienists on the BODEX.
8. Increases, from two to four, the number of public members on the BODEX.
AMB
9. Increases, from four to seven, the number of public members on the AMB.
10. Decreases, from eight to five, the number of licensed physicians on the AMB.
11. Decreases, from five to two, the number of AMB members who may be from any one county.
12. Decreases, from four to three, the number of naturopathic physicians on the Naturopathic Board.
13. Increases, from three to four, the number of public members on the Naturopathic Board.
14. Restructures the ASNB to a 9-member board, rather than an 11-member board.
15. Decreases, from six to two, the number of registered nurses on the ASNB.
16. Increases, from two to five, the number of public members on the ASNB.
17. Decreases, from two to one, the number of licensed practical nurses on the ASNB.
18. Decreases, from five to three, the number of licensed dispensing opticians on the Dispensing Opticians Board.
19. Increases, from two to four, the number of public members on the Dispensing Opticians Board.
20. Decreases, from five to three, the number of licensed optometrists on the Optometry Board.
21. Increases, from two to four, the number of public members on the Optometry Board.
22. Decreases, from five to three, the number of licensed osteopathic physicians on the ABOE.
23. Increases, from two to four, the number of public members on the ABOE.
24. Decreases, from six to three, the number of licensed pharmacists on the ASPB.
25. Increase, two to five, the number of public members on the ASPB.
26. Decreases, from four to two, the number of licensed physical therapists on the Physical Therapy Board.
27. Increases, from two to four, the number of public members on the Physical Therapy Board.
28. Decreases, from seven to four, the number of licensed professionals on the Psychologist Board.
29. Requires the Psychologist Board members who are licensed professionals to include:
a) one, rather than two, licensed psychologist who is a full-time faculty member from an Arizona university with a psychology doctoral program;
b) two, rather than three, psychologists in professional practice; and
c) one, rather than two, behavioral analyst.
30. Increases, from three to six, the number of public members on the Psychologist Board.
31. Restructures the AZPA to a 9-member board, rather than an 11-menber board.
32. Decreases, from five to two, the number of licensed physician assistants on the AZPA.
33. Increases, from two to five, the number of public members on the AZPA.
34. Decreases, from two to one, the number of licensed allopathic physicians on the AZPA.
35. Decreases, from two to one, the number of licensed osteopathic physicians on the AZPA.
36. Decreases, from five to three, the number of homeopathic physicians on the Homeopathic Board.
37. Increases, from two to four, the number of public members on the Homeopathic Board
38. Restructures the AzBBHE to a 9-member board, rather than a 12-member board.
39. Decreases, from two to one, the number of licensed social workers on the AzBBHE.
40. Decreases, from two to one, the number of licensed in counselors on the AzBBHE.
41. Decreases, from two to one, the number of licensed marriage and family therapists on the AzBBHE.
42. Decreases, from two to one, the number of licensed addiction counselors on the AzBBHE.
43. Increases from four to five, the number of public members on the AzBBHE.
44. Decreases, from three to two, the numbers of occupational therapists on the Occupational Therapy Board.
45. Increases, from two to three, the number of public members on the Occupational Therapy Board
46. Restructures the Respiratory Care Board to a 9-member board, rather than a 7-member board.
47. Decreases, from three to two, the number of licensed respiratory care practitioners on the Respiratory Care Board.
48. Increases, from two to five, the number of public members on the Respiratory Care Board.
49. Restructures the Acupuncture Board to a 9-member board, rather than a 7-member board.
50. Decreases, from three to two, the number are licensed acupuncturists on the Acupuncture Board.
51. Increases, from two to five, the number of consumer members on the Acupuncture Board.
Athletic Training Board
52. Decreases, from three to two, the number of licensed athletic trainers on the Athletic Training Board.
53. Increases, from two to three, the number of public members on the Athletic Training Board.
54. Restructures the NCIA Board to a 13-member board, rather than an 11-member Board.
55. Decreases, from two to one, the number of licensed assisted living center managers on the NCIA Board.
56. Increase, from one to two, the number of family members of either a resident or a person who was a resident in a skilled nursing facility or an assisted living facility on the NCIA Board.
57. Increases, from one to two, the number of persons who are current or former residents of a skilled nursing facility or an assisted living facility on the NCIA Board.
58. Adds to the NCIA Board one public member who does not have a direct or indirect financial interest in nursing care institutions or assisted living facilities.
Miscellaneous
59. Allows all persons serving as board members on the general effective date to continue to serve until the expiration of their normal terms.
60. Requires the Governor to make subsequent appointments in accordance with the restructured board membership.
61. Makes technical and conforming changes.
62. Becomes effective on the general effective date.
