board of executive clemency; continuation

Purpose

Continues the Board of Executive Clemency (BOEC) for 5 years.

Background

Statute requires the BOEC to perform a variety of responsibilities related to the BOEC's exclusive power to pass on and recommend reprieves, commutations, paroles and pardons to the Governor. The BOEC consists of five members appointed by the Governor on the basis of professional or educational qualifications and a demonstrated interest. Members are appointed to five-year terms and no more than two members may be of the same professional discipline (A.R.S. §§ 31-401 and 31-402).

The Senate Judiciary and Elections Committee of Reference (COR) held a public meeting on Thursday, January 23, 2025, to review the Auditor General's performance audit and sunset review, consider the BOEC's responses to the statutorily outlined sunset factors and receive public testimony. The COR recommended that the BOEC be continued (COR Report). The BOEC is set to terminate on July 1, 2025, unless continued by the Legislature (A.R.S. § 41-3025.13).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Continues, retroactive to July 1, 2025, the BOEC until July 1, 2030.

2.   Repeals the BOEC on July 1, 2030.

3.   Contains a purpose statement.

4.   Becomes effective on the general effective date, with a retroactive provision as noted.
