implements of husbandry; autonomous; automated
Purpose
Expands the definition of an implement of husbandry to add an implement or vehicle that is an autonomous vehicle or uses an autonomous driving system.
Background
An automated driving system is the hardware and software that are collectively capable of performing the entire dynamic driving task on a sustained basis, regardless of whether it is limited to a specific operational design domain (A.R.S. § 28-101). An autonomous vehicle is a motor vehicle that is equipped with an automated driving system and the operation of an autonomous vehicle, with or without a human driver, is subject to all applicable federal and state laws (A.R.S. § 28-9702).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Expands the definition of an implement of husbandry to include an implement or vehicle that is autonomous or uses an autonomous driving system that is used solely for agricultural purposes and is only incidentally moved or operated on a highway whether as a trailer or an autonomous vehicle.
2. Adds the preparation or harvesting of specialty crops to the agricultural purposes for which an implement of husbandry must be used.
3. Defines specialty crops as fruits, vegetables, tree nuts, dried fruits and horticulture and nursery crops, including floriculture.
4. Makes technical and conforming changes.
5. Becomes effective on the general effective date.
