FACT SHEET FOR S.B. 1383

Purpose

Requires a school district or charter school that provides routine healthcare services to students in a school health care office to provide a parent or guardian, upon request, the health care credentials of individuals who provide such services. Requires a school district or charter school to provide a parent or guardian, upon request, information describing the types of emergency response training that school employees must complete.

Background

The Arizona State Board of Nursing (AZBN) regulates the practice of nursing by:
1) licensing qualified registered nurses (RN) and practical nurse applicants; and 2) monitoring licensed nurses' compliance with statutory requirements and AZBN-prescribed policies and rules. A qualified applicant may apply to the AZBN for licensure by examination or licensure by endorsement in the manner prescribed by the AZBN (A.R.S. Title 32, Chapter 15).

The AZBN does not require an individual to hold a school nurse certification for employment as a school nurse but allows eligible individuals to apply and receive an optional school nurse certification. To be eligible for a school nurse certification, an applicant must hold a current RN license in good standing or a multistate privilege to practice as an RN in Arizona. The AZBN must grant a school nurse certificate to any applicant who meets the prescribed requirements. A school nurse certificate expires every six years (A.A.C. R4-19-309; AZBN).

A school district governing board must prescribe and enforce policies and procedures that: 1) allow pupils who have been diagnosed with anaphylaxis to carry and self-administer emergency medications as outlined; and 2) allow for the emergency administration of epinephrine auto-injectors by a trained school district employee. A school district governing board may prescribe and enforce policies and procedures for the emergency administration of inhalers by trained school district employees and nurses (A.R.S. ยงยง 15-341 and 15-342).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires each school district and charter school that provides routine health care services to students in the school's health office to provide a student's parent or guardian, upon request, the health care credentials, if any, of each individual who provides routine health care services to students in the school's health office.

2.   Requires each school district or charter school to provide a student's parent or guardian, upon request, information describing the types of emergency response training, including cardiopulmonary resuscitation training, that the school district or charter school requires school employees to complete.

3.   Specifies that a school district or charter school is not required to release the personally identifiable information of a school employee or individual who provides routine health care services to students, including the employee's or individual's:

a)   address;

b)   salary;

c)   social security number; or

d)   telephone number.

4.   Defines health care credentials as a license, certificate, permit or registration to practice health care profession.

5.   Becomes effective on the general effective date.
