ARIZONA STATE SENATE

initiatives; existing law; impact statement
Purpose
Requires initiative descriptions to include a list of statutes that are likely to conflict with or be impacted by the proposed measure with a brief summary of how the statutes may conflict.
Background
Initiative descriptions must be included in the form of petition for a law or amendment to the Arizona Constitution, county legislative measure, city or town ordinance or an amendment to a city or town charter proposed to be submitted directly to electors.
Statute
prescribes language to be included in the body of the initiative description
that includes: 1) a description of the proposed measure; 2) a notice that the
reader has a right to read the text and title before signing; 3) a warning that
not every provision is required to be stated in the description; 4) a signed
statement of approval that the proposed initiative be submitted to voters; 5) a
notice that it is unlawful to sign a petition before a petition has a serial
number; and
6) an appropriate mark designating whether the circulator is paid or a
volunteer (A.R.S.
ยง 19-102).
An initiative is the method by which voters may propose new laws or amend existing laws by gathering signatures from registered voters to place the issue on the ballot (Arizona Secretary of State).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires initiative descriptions to include a list of statutes that are likely to conflict with or be impacted by the proposed measure with a brief summary of how the statutes may conflict.
2. Makes technical changes.
3. Becomes effective on the general effective date.
