Purpose
Allows a 30-day temporary general use registration (temporary registration) to be issued to a nonresident who owns an off-highway vehicle (OHV) titled in another state and continues the Arizona OHV Study Committee (Study Committee) for two years.
Background
In lieu of permanent registration, the Arizona Department of Transportation (ADOT) may issue one temporary registration for the operation of a vehicle for up to 30 days in a 12-month period. Of the $15 temporary registration fee, $14 is deposited in the Arizona Highway User Revenue Fund and $1 is either deposited in the State Highway Fund if registered by the Director of ADOT (Director) or a special registration fund if registered by a county assessor (A.R.S. ยง 28-2156).
Laws 2022, Chapter
148 established the Study Committee to study and collect information about
OHV issues in Arizona and submit an annual report on the Study Committee's
activities and recommendations for legislative or administrative action. The
Study Committee consists of:
1) four legislative members; 2) the Director; 3) the Director of the Arizona
State Parks Board;
4) the Director of the Arizona Game and Fish Department; 5) the Commissioner of
the Arizona State Land Department; 6) a law enforcement officer who enforces
OHV laws; 7) two representatives from OHV organizations; 8) a representative
from a hunting or fishing organization; 9) a representative from the farming
and agriculture industry; 10) a representative from an OHV rental company; 11)
a representative from an OHV manufacturer or retailer; and
12) two public members with outdoor recreation knowledge. The Study Committee
expired on June 1, 2025.
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Continues, retroactive to June 1, 2025, the Study Committee for two years.
2. Allows the Director to authorize the issuance of a temporary registration that allows a person to operate a vehicle for up to 30 days to a person who:
a) is a nonresident; and
b) owns an OHV that is titled in another state and otherwise meets statutory requirements to operate an OHV in Arizona.
3. Allows a registering officer to issue more than one temporary registration within a 12-month period to a nonresident who owns an out-of-state OHV.
4. Defines OHV as an OHV that:
a) is designed primarily for recreational nonhighway all-terrain travel;
b) is no more than 80 inches in width;
c) has an unladen weight of up to 2,500 pounds;
d) has a steering wheel for steering control, a rollover protective structure and an occupant retention system; and
e) travels on four or more non-highway tires.
5. Repeals the Study Committee on June 1, 2027.
6. Makes technical and conforming changes.
7. Becomes effective on the general effective date with a retroactive provision as noted.
Amendments Adopted by Committee of the Whole
1. Adds the two-year continuation of the Study Committee.
2. Reinstates the maximum unladen weight of an all-terrain vehicle or OHV to be 2,500 pounds, rather than 3,500 pounds.
3. Makes conforming changes.
