voter registrations; recorder; inactive status

Purpose

Allows a county recorder to place a person's voter registration information in paused status on receipt of information that provides reasonable cause to believe a person's registration information does not match existing records or open-source public data.

Background

Statute requires a county recorder to send any mail to an elector by nonforwardable
first-class mail marked with the statement required by the postmaster to receive an address correction notification. The county recorder must send a follow-up notice within three weeks of receipt of notice that an item was returned undelivered. The follow-up notice must be sent to the address that appears in the general county register or to the forwarding address provided by the United States Postal Service (USPS). Statute requires the notice to state that if the elector does not complete and return a new registration form with current information to the county recorder or make changes to the elector's voter registration information that is maintained online within 35 days, the elector's registration status must be changed from active to inactive.

The county recorder may use the change of address information supplied by USPS through its licensees and the information provided by an electronic voter registration information center to identify registrants whose addresses may have changed. The county recorder must send the registrant a notice of the change by forwardable mail and a postage prepaid preaddressed return form or an appropriate internet address for revising voter registration information by which the registrant may verify or correct the registration information. If the registrant fails to revise the information or return the form postmarked no later than 35 days after the mailing of the notice, the elector's registration status must be changed (A.R.S. ยง 16-166).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Allows a county recorder to place a person's voter registration information in paused status, and provide notice of this action, on receipt of information that provides reasonable cause to believe a person's registration information does not match existing records or open-source public data.

2.   Defines paused status to mean a temporary status in the statewide voter registration database.

3.   Specifies that a voter in paused status is allowed to vote in any election for which the voter is eligible if the voter provides the county recorder with the appropriate corrective information.

4.   Becomes effective on the general effective date.
