provisional ballots; cure data

Purpose

Adds provisional ballot voters whose signatures require curing to the list of voters that the county recorder or other officer in charge of elections must send to the political parties on a daily basis through the end of the signature cure period.

Background

To receive a ballot at a polling location, an elector must present: 1) a valid form of identification bearing their photograph, name and address; 2) two different items containing the name and address of the elector that is the same name and address in the precinct register; or 3) a valid form of identification that does not appear to be the same address as in the precinct register and one item containing the name and address of the elector that is the same as in the precinct register. An elector who provides no proof of identity or invalid proof of identity must be issued a conditional provisional ballot. If the voter provides identification, but the name or address does not reasonably match the signature roster or e-pollbook, the voter should be issued a provisional ballot, rather than a conditional provisional ballot (A.R.S. § 16-579; EPM Ch. 9 (IV)).

A voter who votes by conditional provisional ballot must provide proof of identification to the county recorder or other officer in charge of elections by the fifth business day after a primary, general or special election that includes a federal office or the third business day after any other election. Beginning on the Wednesday immediately following the election through the end of the signature cure period after a primary, general or special election that includes a federal office, or the third business day for any other election, the county recorder or other officer in charge of elections must submit daily to the political parties that are qualified for continued representation on the state ballot an updated list of all voters whose signatures are inconsistent with the voter's signature on the voter's registration record and all voters who voted with a conditional provisional ballot (A.R.S. § 16-550).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Adds provisional ballot voters whose signatures require curing to the list of voters that the county recorder or other officer in charge of elections must send each day, through the end of the signature cure period, to the political parties who are qualified for continued representation on the state ballot.

2.   Makes technical changes.

3.   Becomes effective on the general effective date.
