FACT SHEET FOR H.B. 2077

 

ASRS; long-term disability

Purpose

Specifies that, for an Arizona State Retirement System (ASRS) member to qualify for
long-term disability (LTD) benefits, the disability must have occurred while employed for an ASRS employer.

Background

The LTD program is established under ASRS and is administered by the ASRS Board. The LTD program provides for a monthly benefit designed to partially replace lost income if a member is unable to work due to an illness or injury. The ASRS Board determines the rights, benefits and obligations of any person seeking LTD benefits. An ASRS member is considered to have a disability if, based on objective medical evidence: 1) during the first 30 months of the disability period, the member is unable to perform one or more duties of the occupation held by the member when the member developed a disability; and 2) for a member who has received monthly LTD program benefits for 24 months within a five-year period, the member is unable to perform any work for compensation or gain for which the member is reasonably qualified by education, training or experience in an amount at least equal to the scheduled LTD program benefits (A.R.S. ยงยง 38-797.01; 38-797.03; 38-797.04; and 38-797.07).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1. Specifies that, for an ASRS member to qualify for LTD benefits, the disability must have occurred while employed for an ASRS employer.

2. Becomes effective on the general effective date.
