ARIZONA STATE SENATE

real estate; definition of contiguous
Purpose
Modifies the definition for contiguous relating to subdivision requirements.
Background
Contiguous means lots, parcels or fractional interests that share a common boundary or point and does not include lots, parcels or fractional interests that are separated by either of the following: 1) a barrier; or 2) a road, street or highway that has been established by the state or by any agency or political subdivision of the state, that has been designated by the federal government as an interstate highway or that has been regularly maintained by the state or by any agency or political subdivision of the state and has been used continuously by the public for at least the last five years (A.R.S. ยง 32-2101).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Adds, to the definition of contiguous, lots, parcels or fractional interests that are separated by a private road or street.
2. Specifies that the definition of contiguous excludes lots, parcels or fractional interests that are separated by a public road, street or highway that has been established by Arizona or by any agency or political subdivision of Arizona, that has been dedicated to and accepted by Arizona or by any political subdivision of Arizona, that has been designated by the federal government as an interstate highway or that has been regularly maintained by Arizona or by any agency or political subdivision of Arizona and has been used continuously by the public for at least the last five years.
3. Makes conforming changes.
4. Becomes effective on the general effective date.
