Purpose
Establishes special plates for 988 suicide awareness, Arizona bicycling, education fundraising, the Hopi Tribe, made in Arizona, public safety personnel mental health, sororities and fraternities and a youth charities organization.
Background
The
Arizona Department of Transportation (ADOT) Motor Vehicle Division provides one
license plate to every motor vehicle owner for each vehicle registered. ADOT
must issue or renew special plates in lieu of regular license plates under
specified conditions and procedures. The fee for obtaining or renewing a
special plate is $25. Of the $25 fee, $8 is an administration fee that ADOT
deposits in the State Highway Fund (SHF) and $17 is a donation (A.R.S.
§§ 28-2351;
28-2402;
and 28-2403).
All license plates, including special plates, that are designed or redesigned on or after September 24, 2022, must have: 1) the state name, Arizona, in capital letters in sans serif font and three-fourths of an inch in height; and 2) a background color that contrasts significantly with the color of the letters, numbers and state name (A.R.S. § 28-2351).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
988 Suicide Awareness Special Plate
1. Requires ADOT to issue 988 suicide awareness special plates if by December 31, 2025, a person pays the $32,000 implementation fee.
2. Requires the person that pays the $32,000 implementation fee to design the 988 suicide awareness special plate.
3. Subjects the design and color of the 988 suicide awareness special plate to the approval of ADOT.
4. Allows the Director of ADOT (Director) to combine a request for a 988 suicide awareness special plate with a request for a personalized special plate.
5. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the 988 suicide awareness special plate and personalized special plate.
6. Specifies that, of the $25 fee required to obtain or renew a 988 suicide awareness special plate, $8 is an administration fee and $17 is an annual donation.
7. Establishes the 988 Suicide Prevention Special Plate Fund which is to be administered by the Director of the Department of Health Services (DHS).
8. Requires ADOT to deposit all special plate administration fees in the SHF and transmit the 988 suicide awareness special plate donations to the 988 Suicide Prevention Special Plate Fund.
9. Requires the first $32,000 in the Suicide Prevention Special Plate Fund to be reimbursed to the person that paid the implementation fee.
10. Requires the Director of DHS to annually allocate 988 Suicide Prevention Special Plate Fund monies to an entity in Arizona that supports the continued operation of and answer calls in Arizona from the National 988 Suicide and Crisis Lifeline.
11. Caps, at 10 percent, the annual amount of 988 Suicide Prevention Special Plate Fund monies that may be used to administer the Fund.
12. Requires, on notice from the Director of DHS, the State Treasurer to invest and divest 988 Suicide Prevention Special Plate Fund monies and credit monies earned to the Fund.
13. Specifies that 988 Suicide Prevention Special Plate Fund monies are continuously appropriated.
Arizona Bicycling Special Plate
14. Requires ADOT to issue an Arizona bicycling special plate if, by December 31, 2024, a person pays the $32,000 implementation fee.
15. Requires the Arizona bicycling special plate to be of uniform design and include space for one Arizona bicycling logo.
16. Requires a person that pays the $32,000 implementation fee and that meets the prescribed requirements to qualify as an entity to design an Arizona bicycling logo.
17. Subjects the design and color of Arizona bicycling logos to the approval of ADOT.
18. Allows the Director to combine a request for an Arizona bicycling special plate with a request for a personalized special plate.
19. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the Arizona bicycling special plate and personalized special plate.
20. Specifies that, of the $25 fee required to obtain or renew an Arizona bicycling special plate, $8 is an administration fee and $17 is an annual donation.
21. Establishes the Arizona Bicycling Special Plate Fund which is to be administered by the Director.
22. Requires ADOT to deposit all special plate administration fees in the SHF and transmit the Arizona bicycling special plate donations to the Arizona Bicycling Special Plate Fund.
23. Requires the first $32,000 in the Arizona Bicycling Special Plate Fund to be reimbursed to the entity that paid the implementation fee.
24. Requires the Director to annually allocate Arizona Bicycling Special Plate Fund monies to:
a) the entity that paid the implementation fee; and
b) entities that have paid the Arizona bicycling special plate fee to ADOT based on the total number of Arizona bicycling special plates issued to each entity.
25. Requires an entity to be a 501(c)(3) organization that:
a) produces or participates in bicycling events in Arizona for community, charity and wellness; and
b) has the following objectives:
i. aiding in the economic development of Arizona;
ii. establishing Arizona as the bicycle center of the United States; and
iii. encouraging individuals to adopt bicycling as a natural daily life activity.
26. Caps, at 10 percent, the annual amount of Arizona Bicycling Special Plate Fund monies that may be used to administer the Fund.
27. Requires, on notice from the Director, the State Treasurer to invest and divest Arizona Bicycling Special Plate Fund monies and credit monies earned to the Fund.
28. Specifies that Arizona Bicycling Special Plate Fund monies are continuously appropriated.
Education Fundraising Special Plate
29. Requires ADOT to issue education fundraising special plates if by December 31, 2025, a person pays the $32,000 implementation fee.
30. Requires the person that pays the $32,000 implementation fee to design the education fundraising special plate.
31. Subjects the design and color of the education fundraising special plate to the approval of ADOT.
32. Allows the Director to combine a request for an education fundraising special plate with a request for a personalized special plate.
33. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the education fundraising special plate and personalized special plate.
34. Specifies that, of the $25 fee required to obtain or renew an education fundraising special plate, $8 is an administration fee and $17 is an annual donation.
35. Establishes the Education Fundraising Special Plate Fund which is to be administered by the Director.
36. Requires ADOT to deposit all special plate administration fees in the SHF and transmit the education fundraising special plate donations to the Education Fundraising Special Plate Fund.
37. Requires the first $32,000 in the Education Fundraising Special Plate Fund to be reimbursed to the entity that paid the implementation fee.
38. Requires the Director to annually allocate Education Fundraising Special Plate Fund monies to an entity that is a 501(c)(3) organization that:
a) has a mission of community fundraising to fuel access, innovation and excellence within one unified school district in the state;
b) achieve this mission through events, campaigns and partnerships; and
c) use any monies raised through fundraising to promote equitable access to learning and enrichment opportunities, stimulate classroom innovation and ensure academic excellence for one unified school district in the state.
39. Caps, at 10 percent, the annual amount of Education Fundraising Special Plate Fund monies that may be used to administer the Fund.
40. Requires, on notice from the Director, the State Treasurer to invest and divest Education Fundraising Special Plate Fund monies and credit monies earned to the Fund.
41. Specifies that Education Fundraising Special Plate Fund monies are continuously appropriated.
42. Defines a unified school district as a political subdivision of the state offering instruction to students in programs for preschool children with disabilities and kindergarten programs and grades 1 through 12.
Hopi Tribe Special Plate
43. Requires ADOT to issue a Hopi Tribe special plate if, by December 31, 2025, a person pays the $32,000 implementation fee.
44. Requires the person that pays the $32,000 implementation fee to design the Hopi Tribe special plate.
45. Subjects the design and color of the Hopi Tribe special plate to the approval of ADOT.
46. Allows the Director to combine a request for a Hopi Tribe special plate with a request for a personalized special plate.
47. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the Hopi Tribe special plate and the personalized special plate.
48. Specifies that, of the $25 fee required to obtain or renew a Hopi Tribe special plate, $8 is an administration fee and $17 is an annual donation.
49. Requires ADOT to deposit all special plate administration fees in the SHF and transmit all donations collected to the Hopi Tribal Department of Public Safety and Emergency Services.
50. Requires the Hopi Tribe to use donated monies for:
a) road maintenance services; and
b) traffic control devices that conform to the Manual on Uniform Traffic Control Devices on highways on the Hopi Tribal Reservation that are located in Arizona and are not state highways.
Made in Arizona Special Plate
51. Requires ADOT to issue made in Arizona special plates if by December 31, 2025, a person pays the $32,000 implementation fee.
52. Requires the person that pays the $32,000 implementation fee to design the made in Arizona special plate.
53. Subjects the design and color of the made in Arizona special plate to the approval of ADOT.
54. Allows the Director to combine a request for a made in Arizona special plate with a request for a personalized special plate or a low emission and energy efficient vehicle special plate.
55. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the:
a) made in Arizona special plate and personalized special plate; or
b) made in Arizona special plate and low emission and energy efficient vehicle special plate.
56. Specifies that, of the $25 fee required to obtain or renew a made in Arizona special plate, $8 is an administration fee and $17 is an annual donation.
57. Establishes the Made in Arizona Special Plate Fund which is to be administered by the Arizona Commerce Authority (ACA).
58. Requires ADOT to deposit all special plate administration fees in the SHF and transmit the made in Arizona special plate donations to the Made in Arizona Special Plate Fund.
59. Requires the first $32,000 in the Made in Arizona Special Plate Fund to be reimbursed to the person that paid the implementation fee.
60. Requires Chief Executive Officer of the ACA to annually allocate Made in Arizona Special Plate Fund monies to support a program that:
a) advances workforce development in Arizona in the advanced manufacturing industry; and
b) fosters collaboration with community colleges located in the state and the advanced manufacturing industry.
61. Caps, at 10 percent, the annual amount of Made in Arizona Special Plate Fund monies that may be used to administer the Fund.
62. Requires, on notice from the Chief Executive Officer of the ACA, the State Treasurer to invest and divest Made in Arizona Special Plate Fund monies and credit monies earned to the Fund.
63. Specifies that Made in Arizona Special Plate Fund monies are continuously appropriated.
Public Safety Personnel Mental Health Special Plate
64. Requires ADOT to issue public safety personnel mental health special plates if by December 31, 2025, a person pays the $32,000 implementation fee.
65. Requires the person that pays the $32,000 implementation fee to design the public safety personnel mental health special plate.
66. Subjects the design and color of the public safety personnel mental health special plate to the approval of ADOT.
67. Allows the Director to combine a request for a public safety personnel mental health special plate with a request for a personalized special plate.
68. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the public safety personnel mental health special plate and personalized special plate.
69. Specifies that, of the $25 fee required to obtain or renew a public safety personnel mental health special plate, $8 is an administration fee and $17 is an annual donation.
70. Establishes the Public Safety Personnel Mental Health Special Plate Fund which is to be administered by the Director.
71. Requires ADOT to deposit all special plate administration fees in the SHF and transmit the public safety personnel mental health special plate donations to the Public Safety Personnel Mental Health Special Fund.
72. Requires the first $32,000 in the Public Safety Personnel Mental Health Special Fund to be reimbursed to the person that paid the implementation fee.
73. Requires the Director to annually allocate Public Safety Personnel Mental Health Special Fund monies to an entity that is a 501(c)(3) organization that provides:
a) anonymous mental health wellness and suicide prevention for public safety personnel and family members of public safety personnel; and
b) stress coaching that focuses on public safety personnel, family members of public safety personnel and public safety organizations, including:
i. proactive and resiliency training to assist public safety personnel to recognize early warning signs in themselves and their colleagues;
ii. family support to assist family members of public safety personnel in understanding the unique stressors associated with a public safety lifestyle and recognizing early warning signs; and
iii. personalized support for public safety personnel and family members of public safety personnel which is available 24 hours a day.
74. Caps, at 10 percent, the annual amount of Public Safety Personnel Mental Health Special Fund monies that may be used to administer the Fund.
75. Requires, on notice from the Director, the State Treasurer to invest and divest Public Safety Personnel Mental Health Special Fund monies and credit monies earned to the Fund.
76. Specifies that Public Safety Personnel Mental Health Special Fund monies are continuously appropriated.
Sorority and Fraternity Special Plate
77. Requires ADOT to issue a sorority and fraternity special plate if, by December 31, 2024, a sorority or fraternity pays the $32,000 implementation fee.
78. Requires the sorority and fraternity special plate to be of uniform design and include space for one sorority or fraternity logo.
79. Requires the sorority or fraternity that pays $32,000 to ADOT and that meets the outlined requirements to design a logo for the sorority or fraternity that is different from designs for other sorority or fraternity logos.
80. Subjects the design and color of sorority and fraternity logos to the approval of ADOT.
81. Allows the Director to combine a request for a sorority and fraternity special plate with a request for a personalized special plate.
82. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the sorority and fraternity special plate and personalized special plate.
83. Specifies that, of the $25 fee required to obtain or renew a sorority and fraternity special plate, $8 is an administration fee and $17 is an annual donation.
84. Establishes the Sorority and Fraternity Special Plate Fund which is to be administered by the Director.
85. Requires ADOT to deposit all special plate administration fees in the SHF and sorority and fraternity special plate donations to the Sorority and Fraternity Special Plate Fund.
86. Requires the Director to annually allocate Sorority and Fraternity Special Plate Fund monies to:
a) the sorority or fraternity that paid the implementation fee; and
b) sororities and fraternities that have paid the sorority and fraternity special plate fee to ADOT based on the total number of sorority and fraternity special plates issued to each sorority or fraternity.
87. Requires a sorority or fraternity to be recognized by a university in the state and have a mission to:
a) foster cooperative actions of its members in dealing with matters of mutual concern;
b) promote the wellbeing of its affiliate sororities and fraternities, facilitate the establishment and development of local councils and provide leadership training for its constituents; and
c) educate citizens and communities in Arizona in the interest of the general public through community education, literature and broadcast information with respect to:
i. government issues about methodologies and strategies to improve, maintain and promote the needs and knowledge of state residents; and
ii. economic development, public safety and access to educational opportunities so that state residents can serve for the protection, conservation and preservation of their human and natural environment in and around the Arizona.
88. Requires, on notice from the Director, the State Treasurer to invest and divest Sorority and Fraternity Special Plate Fund monies and credit monies earned to the Fund.
89. Specifies that Sorority and Fraternity Special Plate Fund monies are continuously appropriated.
Youth Charities Organization Special Plate
90. Requires ADOT to issue youth charities organization special plates if by December 31, 2025, a person pays the $32,000 implementation fee.
91. Requires the person that pays the $32,000 implementation fee to design the youth charities organization special plate.
92. Subjects the design and color of the youth charities organization special plate to the approval of ADOT.
93. Allows the Director to combine a request for a youth charities organization special plate with a request for a personalized special plate.
94. Specifies that a combined request must be submitted in a form prescribed by the Director and is subject to the fees for both the youth charities organization special plate and personalized special plate.
95. Specifies that, of the $25 fee required to obtain or renew a youth charities organization special plate, $8 is an administration fee and $17 is an annual donation.
96. Establishes the Youth Charities Organization Special Plate Fund which is to be administered by the Director.
97. Requires ADOT to deposit all special plate administration fees in the SHF and transmit the youth charities organization special plate donations to the Youth Charities Organization Special Plate Fund.
98. Requires the first $32,000 in the Youth Charities Organization Special Plate Fund to be reimbursed to the person that paid the implementation fee.
99. Requires the Director to annually allocate Youth Charities Organization Special Plate Fund monies to an entity that is a 501(c)(3) organization that:
a) is headquartered in Arizona;
b) has been incorporated in Arizona in March 1996;
c) exclusively supports Arizona children's charities through at least two annual fundraising events; and
d) is affiliated with a membership-based organization that is headquartered in Scottsdale, Arizona that consists of an active membership of up to 65 members under 40 years old.
100. Caps, at 10 percent, the annual amount of Youth Charities Organization Special Plate Fund monies that may be used to administer the Fund.
101. Requires, on notice from the Director, the State Treasurer to invest and divest Youth Charities Organization Special Plate Fund monies and credit monies earned to the Fund.
102. Specifies that Youth Charities Organization Special Plate Fund monies are continuously appropriated.
Miscellaneous
103. Makes conforming changes.
104. Becomes effective on the general effective date.
