ARIZONA STATE SENATE

early voting list; undeliverable ballots
Purpose
Requires the county recorder, or officer in charge of elections, to remove the voter from the Active Early Voting List (AEVL) if the AEVL notice is returned undeliverable by the post office.
Background
In order to be included in the AEVL, a voter must make a written request that their name be added to the list. The application must allow the voter to provide the voter's name, residence address, mailing address in the voter's county of residence, date of birth and signature. No less than 90 days before any polling place election scheduled in March or August, the county recorder or other officer in charge of elections must mail, to all voters who are eligible for the election and included on the AEVL, a notice by nonforwardable mail that is marked with the statement required by the postmaster to receive an address correction notification. The notice must be delivered with return postage prepaid and include: 1) a means for the voter to change the mailing address for the voter's ballot to another location in the voter's county of residence; 2) update the voters residence address in the voter's county of residence; and 3) request that the voter not be sent a ballot for the upcoming election, or elections indicated on the notice.
If the notice is returned undeliverable by the postal service, the county recorder or other officer in charge of elections must take the necessary steps to contact the voter at the voter's new residence address to update that voter's address or to move the voter to inactive status. A voter moved to inactive status must be removed from the AEVL. If the voter is removed from the AEVL, the voter must only be added to the list again if the voter submits a new request (A.R.S. ยง 16-544).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires the county recorder or officer in charge of elections to move a voter to inactive status and remove the voter from the AEVL if an AEVL notice mailed to the voter is returned undeliverable.
2. Removes the requirement for the county recorder or officer in charge of elections to take necessary steps to contact the voter at the voter's new residence address in order to update that voter's address.
3. Makes conforming changes.
4. Becomes effective on the general effective date.
